Class Action Suit Withdrawn Without Prejudice
The Class Action lawsuit brought on by Greg Brockwell and Terry Johnson against Sirius Satellite Radio has been withdrawn without prejudice. This does not mean that the suit is totally dead, but the likelihood of it reappearing may well be minimal. The plaintiffs appear to continuing their actions as individuals, but no longer represent the class (shareholders) in this matter.
Position – Long Sirius, Long XM
Yes let them go it alone, that does not bother me, because generally those kinds of suits, plaintiffs get stuck paying the fees. Somehow I dought they will carry it forward.
Tyler —
What do you think this means to the whole legal mess over the merger, regulatory approval, etc.
Anne, I know I am not Tyler, But here gos nothing. Your answer is,…….. NOTHING. the suit here has nothing to do with the FCC, or any regulations, concerning the merger. Even if it was a true suit with real meaning behind it.
John —
Thanks. So you’re saying that these are two guys (investors) who were after some cash and not really interested in what happens with the merger? I’ll admit I haven’t followed it as closely as I should have — I have Sirius SR and I don’t want to lose it if the two companies can’t merge and end up going out of business. I also don’t want to be left in some SR limbo if they do eventually merge and can’t agree on how to deal with any differences in hardware, programming etc.
Anne, IMO, and alot of others, it is clear that the two were a front for the law firm, that wanted to make money on attorneys fees. Both have a history of doing multiple class action suits. Brockwell only has 1,000 shares of SIRI had has gone through alot of trouble to file suit to get what amounts to nothing. The only enity that would have gotten anything of real value would have been the law firm.
