Screw my feelings..... You are discrediting my intentions on being a Truth Seeker and posting here or anywhere else.... My posts are not to manipulate or to cause fear.... My timing on my trade was perfect not poor, I had posted all day on SA that I was looking for news from the company as to their reporting of the 10K and that if there wasn't any news that I thought that they would be filing an extension, and I took the position that I viewed their filing as negative.... What? Filing the extension is Good? Are you kidding me? Now whose being irresponsible?? .... I need to get a beer... to calm down.... you have certainly disappointed me and now Pissed me Off...... F;k fearmongering .... and they have never issued this warning before.... why don't you get your facts straight.......

It is with great distress that I put pen to paper, or in this case fingers to keyboard. Sometimes people believe that SiriusBuzz is SiriusPump. Nothing could be further from the truth and the buzz right now, is chapter 11. In a filing with the SEC, Sirius XM states:

* In the event such uncertainties remain unresolved, management anticipates that KPMG LLP’s auditors’ report relative to the Company’s 2008 consolidated financial statements will contain an explanatory paragraph indicating substantial doubt about the Company’s ability to continue as a going concern.

* … the inclusion of such a paragraph by KPMG LLP would result in a default under certain indebtedness of the Company, XM Holdings and XM Satellite Radio Inc. (“XM Inc.”) which defaults, if not cured or waived prior to the expiration of the applicable grace period, would result in an event of default under other indebtedness of the Company, XM Holdings and XM Inc. Such events of default, if they occur, provide the lenders the right to demand all amounts due under the respective agreements immediately due and payable.

In a nutshell, unless Sirius XM retires its May debt prior to its 10K being released, its only choice is Chapter 11. A simple statement of potential default is reason to cause a default in this case.

A further problem develops as we learn that that company itself is examining whether it makes sense to continue operations under such economic circumstances. All of this had been relative to operational results as of December 31,2008.

Management has not yet completed its evaluation as to whether substantial doubt exists relative to the Company’s ability to continue as a going concern for a reasonable period of time. A significant element of that evaluation relates to uncertainties associated with funding of amounts stipulated in the aforementioned Investment Agreements. These uncertainties may not be resolved by the time the Company files its Form 10-K with the Securities and Exchange Commission.

Unfortunately, auto sales data for the first two months of Q1 2009 shows that it is even more likely that the company will come to the conclusion that it cannot continue operations under its current debt and contractual obligations. A 9.1 million run rate and 1.7% churn rate equal a net loss of nearly 2 million subscribers in 2009 by my calculations, which have been heavily challenged in the SiriusBuzz forums.

As for any talk of why Malone would have stepped in. The answer may be as simple as intending to keep the assets out of the hands of Charles Ergen, so that some form of Sirius might emerge after bankruptcy.

Guys..I just have to step in and say something...you guys are among the most trusted and knowledgeable cats here. We've all come a long way together and are near claiming what we have fought for all this time: reconciliation. I think the last few days, getting kicked out of our previous stomping grounds and dealing with the 12b etc... have been trying at best. I think we're back on solid footing and should look forward to what's to come. I think we have enough positives in hand. Let Brandon write his article of fear. He feels like he's been called to write it..So be it. We should stay focused on our matters at hand and not be distracted...make any sense??

I just hope this fine group is not imploding! Even though I'm new to the board and have only recently posted, my lurking has provided me an education about this company I could never have learned otherwise. Let's hang tight!

I can't even make sense of what your saying.... the extension was discussed after Foolnhismoney and I debated the requirement for filing over a week ago... I never heard you talk about an extension at all. I didn't get Brandon to do anything... he is an independent thinker... and I don't even know him other than the articles he rights... you have conspiracy everywhere in your writings.... its just not that way with me....

this "article" is nothing less than irresponsible. As said. Who freakin cares? Brandon controls no one and esp, he does not control SIRI's SP. This is the wildest conjecture I've heard in a while. He should really just go work for WSJ. He's great at 'mongering..perfect fit. Nice Brandon. Real nice dude...

Or more appropriately, he should go work for Motley Fool or 24wallst. Do these guys (Charles, Tyler, and Brandon) collaborate before these inflammatory pieces go up does any one of the three simply have carte blanche. Charles is the owner... surprised he puts up with it.

You have every right to be angry. I remember reading the intial posts from your article and Brandon was the first one to go balistik. He yelled fire in a dark theater...He said something like "uh oh, this is NOT GOOD" Then he started making everyone else crazy cause they listen to him and then it became like a forest fire in the hands of Santa Ana winds. Now look what he's done. Outright wild conjectured interpretation of the filing. If I didn't know him from SA, I'd say he should be admited to a ward...
