I'll reverse roles and play John to Homer here,John is right,i do remember him talking about not writing articles here or anywhere,and also remember him talking about working at a radio station or stations,he knows alot about programming and demographics and bussiness side of radio..JMHO

I have been banned again from the Seeking Alpha site because of the crap Brandon M said about the liberty deal being reverse, I was really terrible in response to people that agreed with him on that and as you know the dumber they are, the worse words I use. None of the old timers left there to get me back this time.

John, don't take this the wrong way, but I am really starting to enjoy your
posts. Actually have been for a while. Wrong first impression of you. Either I'm toughening up or your softening up, either way I value your insights.

I am not really up on this but if I recall the highest is 8% and the increases will come every year until they get to that 8%.

Your right John,here is the agreement from may 10Q,it was settled after this.

Under the terms of the CRB’s decision, we paid a royalty of 6.0% of gross revenues, subject to certain exclusions, for 2007 and 2008, we will pay 6.5% for 2009, 7.0% for 2010, 7.5% for 2011 and 8.0% for 2012. SoundExchange has appealed the decision of the CRB to the United States Court of Appeals for the District of Columbia Circuit. Oral arguments were heard in March 2009. The parties are awaiting the Court’s decision in this matter.

At these rates it comes to 120 mil spent in 07 and also 08,based on 2 bil in gross rev.
09 based on 2.4 bil it's 156 mil paid and going higher,so it is not out of line for royalty fee of $2 and $1 per month to month subs,all who pay right now,that is also .03 to .04 EPS in those years that will go to bottom line..

You get this much better than me. "Someone" is holding this price up???? Three days in a row we test .69 and back up we go. Remeber after CC we plodded along in the .50 range and then bang. Possible again. Not buying SRK's valuation take. This stock doesn't have any idea what it's valuation is.

Im only day trading in these ranges. First long term rebuy back is at .61 cents. Next one is .581. Then I hold for .505. After that, I have one more powder if that .45 gap fills. I am holding no over core since .62 cents. So I missed the boat for full value. Made some of it back trading though.

The US Court of Appeals for the District of Columbia Circuit today issued a decision basically upholding the royalty rates set by the Copyright Royalty Board due under Section 114 of the Copyright Act by satellite radio operators for the public performance of sound recordings. The CRB decision, setting royalties for the years of 2007 to 2012, established rates that grew from 6% to 8% over the six year term. As we explained in our post, here, the Board looked at the the public interest factors set out by Section 801(b) of the Copyright Act, factors not applicable to Internet Radio royalties, in reaching the determination these royalties. Particularly important was the factor which took into account the potential impact of the royalties on the stability of the businesses that would be subject to the royalty, resulting in a reduction of the perceived fair market value of the royalty from what the board determined to be about 13% of gross revenues to the 6-8% final royalty set by the Board. The Court upheld the Board's reasoning, rejecting SoundExchange's challenge to the decision, though the Court did remand the case to the Board to decide the proper allocation of the royalty to the ephemeral rights covered by Section 112 of the Copyright Act.

Ho that was just a low blow. The only thing is would it not be you are going to play homer to john (not john to homer). I mean nobody believes me until it is confirmed by homer or others. Then they say, ho your right homer, why did I see that before. I crack up everytime I see that.
