I hate to say it but I do agree that any artist that has their music played commercially has a right to compensation equal to the amount disbursed to all other artists. The whole pre 1972 stipulation does not realy make much sense. The only thing that does annoy me is that most pre 1970's music publishing rights are owned by publishing companies who are the sole beneficiary of any royalties. This fact is particularly disturbing because it seems like this may have been a setup that was designed to let broadcasters unknowingly build a huge debt before springing an enormous law suit on them. The same trick is used by holders of patents that wait for years to ambush a corporation who is in violation of their patent rights and then file suit for all monies that were acquired as a result. But why target Sirius? Why not all broadcasters? Why are terrestrial broadcasters exempt?

the reasoning that terrestrial broadcasters were/are exempt is because the artists payments were in the form of their music being heard. There were not many other means for artists and their music to gain exposure back then and its just carried over to present day.

Are you kidding? They will let it drop like a rock while they buy back on the cheep. Liberty has never implemented a shred of damage control in the past so why should they step up now?

Had anyone heard of this law suit before yesterday? It was floating around the Internet for a time but seems nobody gave it much merit.

yes i think most here had heard about it. Over the years sirixm has had its fair share of lawsuits and has pretty much won them all one way or another. As far as merit? As with most lawsuit that are filed against siri, it usually gets initial news wire fodder but then after a day or two it goes on the back burner until it becomes an issue....Well yesterday it became an issue and now we have to wait and see how it plays out. They will hold another trial next month to figure out damages....once they find that out.....sirixm will have to decide what they are going to do....I would think if damages are not nominal....they will def appeal.

P is up 2.71% as of now. Doesn't look like higher royalties on pre '72 songs is affecting them much.

Well I believe they have a case in the state of NY against them similar to the one siri has. If a verdict comes back in that case against them whenever it its decided....it prob goes lower then.
