This ruling affects immigrants from Sudan, Haiti, Nicaragua and El Salvador, many of whom have been living in the US for several years and now have children -- and who were facing deportation. A class-action lawsuit accused the Trump administration of having a "political agenda" and being "motivated by racism." I don't know about "racism," though. Trump seems to hate immigrants of all races.

Federal judge rules against Sessions' effort to hit sanctuary cities

A federal district court judge ruled today that Attorney General Jeff Sessions' conditions on grant funding to force so-called sanctuary cities to cooperate with immigration enforcement efforts are unconstitutional. Judge William Orrick of the US District Court for the Northern District of California sided with the state of California and San Francisco in their lawsuit challenging the requirements in granting their request for summary judgment.
The conditions Sessions set in 2017 required sanctuary cities to give immigration officials access to their jails, notify ICE officials of the planned release of a detainee and follow a law that prohibits state and local governments from restricting how much information is shared with the Department of Homeland Security.
Orrick's decision was in agreement with every court that has looked at these issues. He said the conditions violate the separation of power and the information-sharing law is unconstitutional.

Newly seated Justice Brett Kavanaugh spoke up today in defense of the Trump administration’s view that legal immigrants with criminal records can be arrested and held for deportation, even years after they were convicted and completed their sentences. At issue is a federal law that calls for mandatory detention and possible deportation for "criminal aliens," including legal immigrants convicted of crimes ranging from violent felonies to simple drug possession. The law says the Homeland Security secretary "shall take into custody any alien" with a criminal record that could lead to deportation "when the alien is released."
The debate focuses on when exactly is "when"? In a class-action suit brought in California, lawyers for the American Civil Liberties Union complained the mandatory detention policy has been applied to lawful immigrants who had lived and worked in the community for decades after being convicted of misdemeanors, such as drug possession charges. The administration argues that a provision of the 1996 law calls for arresting and jailing such immigrants, despite their good records after serving their time.
Kavanaugh disputed the ACLU’s contention that this mandatory detention rule applies only to immigrants who can be detained at the time they are being released from local jails or state prisons, not to those released years ago. "Congress did not put in a time limit," Kavanaugh said. "It raises a real question over whether we should put in a time limit." Kavanaugh also questioned ACLU arguments that detained immigrants are entitled to bond hearings for release.

Over the course of 12 months, the US Army discharged more than 500 immigrant enlistees who were recruited across the globe for their language or medical skills and promised a fast track to citizenship in exchange for their service, The Associated Press has found. The decade-old Military Accessions Vital to the National Interest recruiting program (MAVNI) was put on hold in 2016 amid concerns that immigrant recruits were not being screened sufficiently. The Army began booting out those enlistees last year without explanation.
The AP has interviewed more than a dozen recruits from countries such as Brazil, Pakistan, Iran, China and Mongolia who all said they were devastated by their unexpected discharges or canceled contracts. Until now, it's been unclear how many were discharged and for what reason because the Army has refused to discuss specific cases. But the Army's own list, submitted to the US District Court for the District of Columbia last month, says 502 service members who enlisted under MAVNI were discharged between July 2017 and July 2018.

The United States allowed more than 300,000 immigrants to temporarily live here. These are immigrants who came from six countries that were hard hit by earthquakes, hurricanes or wars. The Trump administration has now arbitrarily decreed that those six countries -- Haiti, Honduras, Nepal, Nicaragua, Sudan and El Salvador -- have become veritable utopias to which the immigrants can return and dwell in peace and joy forevermore. President Trump today claimed "criminals and unknown Middle Easterners" are "mixed in" with the estimated 7,200 Central American migrants marching towards the US southern border, though he offered no evidence to support the claim.
Trump's warning was included in a string of typo-riddled tweets as the caravan of migrants mostly from Guatemala, Honduras and El Salvador continued their treacherous journey through Mexico towards the U.S.
Many of the migrants are fleeing poverty, starvation and gang violence and are hoping to apply for asylum in the US but the President insisted they are "coming illegally" and vowed his administration will now cut or reduce what he called "the massive foreign aid routinely given" to the Central American nations.
"Sadly, it looks like Mexico's Police and Military are unable to stop the Caravan heading to the Southern Border of the United States," Trump tweeted. "Criminals and unknown Middle Easterners are mixed in. I have alerted Border Patrol and Military that this is a National Emergy [sic]. Must change laws!"
Trump told reporters, "Go to the middle of the caravan, take your cameras and search, okay? You're going to find MS-13, you're going to find Middle Eastern, you're going to find everything. And guess what, we're not allowing them in our country."
Trump’s latest comments drew sharp rebuke from Muslim advocates. "If he actually has evidence to support this racist and Islamophobic dog whistle, he should provide it to the public and explain why 'Middle Eastern' immigrants would be of particular danger to our nation," said Nihad Awad, the national executive director of the Council on American-Islamic Relations. "It is time for this president to be held accountable for his seemingly endless stream of lies and bigoted rhetoric."

No terrorists have ever crossed into the US from Mexico. Every lethal terrorist attack since 9/11 was carried out by a US citizen or legal resident. And yet Trump has never declared, "We need to ban US citizens from this country until we can figure out what the hell is going on." However, he did say we should ban Muslims. He also said Mexicans are rapists and drug dealers and bring crime. Now he's picking on "unknown Middle Easteners" in the hope of stoking fear and getting all his immigrant-hating followers to vote November 6. Trump is a disgrace and an embarrassment to the United States of America.

The caravan of some 7,500 migrants wending its way north through Mexico is a political gift to President Donald Trump, who ran successfully on a get-tough on immigration and terrorism platform during his presidential campaign. Trump tweeted Monday that there are "unknown Middle Easterners" mixed in with the thousands of migrants. The intent of this tweet is surely to play on American fears about the possibility of mysterious Middle Easterners attacking the country, as they did on 9/11.
There is just one problem with this notion: Every lethal terrorist attack in the United States since 9/11 has been carried out by a US citizen or legal resident, according to New America, a research institution that tracks jihadist terrorism cases. In addition, of the more than 400 jihadist terrorist cases prosecuted in the United States in the past 17 years, not one of the terrorists infiltrated the country across the southern border.
Of course, the notion of a terrorist joining a caravan of migrants who are being filmed continuously for many weeks is implausible on its face. But Trump is not going to let facts get in the way of trying to make terrorism an issue as the midterm elections draw closer.

Locking up would-be immigrants is inhumane and unnecessary

The United States has the dubious honor of maintaining the world’s largest immigration detention system. Other countries may house more refugees and temporarily displaced persons, but we lock up the most people whose right to stay in the country is in dispute. Tens of thousands of people a day are held until they’re deported or granted permission to stay by an immigration judge (or at least released on bond or into a sponsor’s custody pending a further hearing).
It is a shameful aspect of US immigration enforcement that the government denies liberty to so many people who have neither been accused nor convicted of a crime. To be sure, every nation has a right to control its borders and determine who gets to come in, for what reasons and through what legal mechanism. We don’t believe that the US should maintain open borders but the government’s historic reliance on detention as a tool for dealing with people accused of arriving or staying here illegally is needlessly expensive, grossly inhumane and unjust to people exercising their legal right to seek asylum.
