Civil lawsuits seeking to hold Donald Trump accountable for the January 6, 2021 insurrection can move forward in court, a federal judge said today in a ruling outlining how the former President could conceivably be responsible for inciting the attack on the US Capitol. Trump’s statements to his supporters before the riot “is the essence of civil conspiracy,” Judge Amit Mehta wrote in a 112-page opinion, because Trump spoke about himself and rallygoers working “towards a common goal” of fighting and walking down Pennsylvania Avenue. “The President’s January 6 Rally Speech can reasonably be viewed as a call for collective action,” Mehta said.
Democratic members of the House and police officers who defended the US Capitol on January 6 sued Trump last year, claiming he prompted his supporters to attack. Friday, Mehta wrote that the three lawsuits could move to the evidence-gathering phase and toward a trial – a major loss in court for Trump. "Tlhe President’s actions here do not relate to his duties of faithfully executing the laws, conducting foreign affairs, commanding the armed forces or managing the Executive Branch,” Mehta wrote. “They entirely concern his efforts to remain in office for a second term. These are unofficial acts, so the separation-of-powers concerns that justify the President’s broad immunity are not present here.”
Two of the lawsuits were brought by Democratic House members while a third was filed by Capitol Police officers. The lawmakers allege that they were threatened by Trump and others as part of a conspiracy to stop the Congressional session that would certify the 2020 Presidential election on January 6, 2021. They argue that Trump should bear responsibility for directing the assaults. Trump’s legal team is likely to appeal the decision.

The House Committee investigating the January 6 insurrection has subpoenaed a lawyer who had reportedly been in contact with then-President Donald Trump the same day a mob of his supporters stormed the US Capitol. The committee today issued letters to six witnesses demanding documents and testimony for what it described as their roles seeking to overturn the election in the leadup to the insurrection. Since being formed last year, the committee has turned its attention in recent months to how efforts by Trump and his inner circle to stay in power allegedly played into the attack.
One of the newly subpoenaed witnesses is Kurt Olsen, a lawyer who previously assisted with unsuccessful efforts to overturn President Joe Biden's 2020 election victory. The committee's letter to Olsen states that he had "multiple telephone calls" with Trump on January 6 after previously providing legal assistance to help the then-President overturn the election.

The House committee can not bring criminal charges against Donald Trump. That will be up to the Department of Justice, which still has filed no obstruction-of-justice charges relating to Trump's conduct during the Mueller investigation – and the statute of limitations on Trump's offenses is expiring in 2022 and 2023. The Department of Justice has filed criminal charges against more than 800 Capitol rioters but still has not indicted Donald Trump, who incited the deadly riot. In response to those who criticize the Attorney General's inaction and call him "Merrick the Mild" or "Merrick the Meek," the Washington Post wrote, "The notion that Attorney General Merrick Garland is slow-walking charges against Trump or has decided to not go after him is inconsistent with the department’s actions to date. Garland might just be warming up to take on the man whose refusal to accept defeat resulted in the most lethal armed insurrection since the Civil War."

In December, Mark Meadows filed a lawsuit against Nancy Pelosi and all nine members of the January 6 Select Committee because they subpoenaed him to testify about the deadly, Trump-incited riot and they subpoenaed his telephone records. Meadows does not want to testify and he says his calls include “intensely personal” and potentially “privileged” communications. We now know why he doesn't want to testify or provide his phone records. He helped Trump plan the riot!

In his ruling, the judge noted that Trump and Eastman "launched a campaign to overturn a democratic election, an action unprecedented in American history. Their campaign spurred violent attacks on the seat of our nation's government, led to the deaths of several law enforcement officers and deepened public distrust in our political process." If the January 6 committee recommends criminal charges be filed against Trump, it will be up to the Department of Justice to do so.
