Changing indeed. We have several guys in our office under 25 that don't pay for cable and think it is crazy to do so. Ala cart entertainment will be a game changer as people just pay for what they watch and not for packages. Hopefully SIRI management has the vision to finish this "marathon" they speak of....:boxer:

The law that applies to situations where state and federal laws disagree is called the supremacy clause, which is part of article VI of the Constitution. The supremacy clause contains what's known as the doctrine of pre-emption, which says that the federal government wins in the case of conflicting legislation. Basically, if a federal and state law contradict, then when you're in the state you can follow the state law, but the feds can decide to stop you. When there is a conflict between a state law and federal law, it is the federal law that prevails. For example, if a federal regulation prohibits the use of medical marijuana, but a state regulation allows it, the federal law prevails.
So, according to federal law, there's nothing to worry about, unless of course, they manage to overturn a federal law which is less than unlikely. So, although annoying, I truly believe there is not much to worry about here. Of course you would never see anything written on SA or elsewhere defending the law as I have clearly outlined above.
BDP i agree with 99% of what you state. My only concern from what little i know about the CA cases....is that the fed law applies from a certain date going forward (1972), yet may be quiet as to pre 72. One could argue that if the fed legislation was quiet to pre 72 then no real conflict of legislation exists between states and feds. it will be interesting to see what the New York Court decides. I am not too worried about it...i just posted the link because it was siri related.

It may be that it "prevails" but it is also unconstitutional in most cases.
Just a little thing called the 10th amendment...of which the constitution would not have been ratified if not included.

Is pretty clear ... to bad most legislators and judges now ignore this.
Most things the Federal government has legislated into law does not truly pass this test.

Another thing on conflict between fed law vs state law is if state law offers more protection than the fed law, state law can rule. Just throwing that out there.....guess im bored. I guess everyone got fed up with SIRI and sold out, I`ll be the next.
I still have a major core position with a .12 ave .. so not every one.
I`m in SIRI for almost the same amt. Don`t know to keep it or dump any more. I don`t think there is much upside any more. Mel gave this Co. away and Malone will suck out anything thats left. Just my own feeling.
I feel like I'm the only guy that buys SIRI regularly anymore :bringit:

Who hoo! Entire market is kicking ass!... Wait a minute... Siri is giving it a nice effort but trailing as usual. Why even bother with this pos when I t's only going to continue to disappoint? And I say that with absolute confidence! What is the twisted psychology behind even thinking of investing... I mean gambling on this stock? I've made more gambling on Dryships in 2 weeks than I have on Sirius in 2 years!
