Breaking: New Draft Proposal Circulated
Reuters is reporting that the Federal Communications Commission were given a new draft proposal today that would give conditional approval of Sirius’ purchase of XM quoting an agency source:
“The FCC revised approval order circulated among the commissioners would allow the deal proceed as long as the companies met a series of consumer protection conditions. ”
Update states that merger could be done this evening, with all votes in. Concessions seem to remain as expected…

If the Commission decides to condition approval of the XM-Sirius merger with “the contemporaneous initiation of an expedited notice and comment proceeding regarding the inclusion of HD receiver capability in satellite receivers”, as was recently demanded by certain groups, we don’t see why there shouldn’t be a similar proceeding regarding inclusion of internet capability in satellite radios. Surely, the Commission agrees that having an internet radio in the car could potentially benefit the public. It would guarantee greater competition for the combined company and boost the fledgling internet radio industry. If the small cost of HD Radio chipsets is reason enough to mandate inclusion of HD reception in satellite radios, perhaps the Commission should consider mandating or at least opening up to public comment the notion of mandating the inclusion of cheap mp3 players/hard drives into satellite radios as well.

Hey, maybe the combined companies should donate money to cancer research. Now that is definitely in the public interest. Maybe the Coalition of Consumers for Cancer Research paid for by Satellite Radio (C3RSR) should look into that.
I am so deflated from the fall of XM and Siri since premarket yesterday after waiting 18 months. All this talk and green lights thinking it’s a done deal, then wait again, the NAB could block, Tate hasn’t voted, Martin hasn’t voted on penalties, blablabla.
I’d have a much nicer weekend if ACTUAL votes and approval are posted by tonight, but who am I kidding.

Sure, in a loser move, DEM Adelstein first voted FOR the merger with conditions before flip flopping and then immediately voting AGAINST it.

Thank you liam for pointing out the fact that the majority of delayers are Republicans. Statements of the Howard Sterns of the world like “I’ll never vote again for a Democrat” is childish grandstanding. If one of the group were Christian, another Jewish, another Muslim, another gay, another straight would that matter at all? We have to get away from the thinking of the 1950s. Sometimes I get mad that I every got involved with this position (despite loving Siri radio and believing in the co.’s future), sometimes I want to throw up, and sometimes I just don’t care. This would have been done and over a long time ago if you democrats would not have voted them in power in the first place.
