    Thanks for the continuing coverage CRF.

    Clearly a ridiculous argument that if was a major concern to the FCC would have been addressed a long time ago, with the introduction of the technology. Hey let's also go after XM radio for providing traffic and weather on their spectrum.

    Additionally, I'm not sure why the feel they need our spectrum to compete. The FCC has the other half of the spectrum out there. Give it to Georgetown, let them launch satellites and... oh wait. We lost them already? That's because they realized that spectrum and infrastructure costs money and they just want to make money off other peoples investments. Gimme gimme.

    As far as the argument of them needing to lease our spectrum to offer immediate competition without having to build and launch satellites:
    1. Whats the timetable for getting your own?
    2. Do we really need to go over this competition argument again, its getting old.

    From April 2007:

    The Coalition asked the question, "... is Sirius even authorized to provide video programming of the sort it proposes on DARS spectrum?" They seemed to answer their own question, citing the follwing, 'the Commission has indicated that it would permit DARS licensees to provide so-called “ancillary services,” so long as such use was not “inconsistent with the international allocation.”'

    Actually, GP is just wrong... they also screwed up...

    In the original DARS licensing, the FCC granted the license holders to have complete "flexibility" to add "non-DARS" and "ancillary services" for use over their bandwidth -- provided it is consistent with the frequency allocation set aside for that specific portion of the spectrum by the ITU... which is the International Telecommunication Union.

    The 2320MHz~2345MHz bandwidth is allocated for:

    Mobile
    Radio-Location
    Fixed Service
    Broadcast-Satellite

    The ITU further defines "broadcast" as any transmission that includes, "sound transmissions, television transmissions or other types of transmissions."

    GP screwed up. In their haste -- they didn't research this out to know that license holders in this portion of the spectrum are legally authorized to transmit TV signals.

    Or better yet, this is merely a PR smearing campaign against Sirius and XM.

    I've never been more disappointed in Jackson and his crew than I am today. I guess the changing of the tide is of little concern to them. You would think they would take a break from the almighty money grab in light of all the recent negative publicity - but I guess not...

    Let me show my cards here... this is from the frequency allocation chart, of what is permitted in this portion of the spectrum -- here in the USA...




    Now this is from the licensing of DARS, released in 1997...

    94. In the Notice, we discussed the possibility of satellite DARS providers offering non-DARS, or ancillary, services. We sought comment on what restrictions, if any, should apply to such services and on how to monitor compliance with any restrictions.

    The applicants have proposed a mix of ancillary services. We agree with the commenters who argue that allowing flexibility consistent with the allocation will allow providers to tailor service offerings to meet consumer needs. Because the United States successfully obtained an international allocation for satellite DARS at WARC-92, we would be concerned about any use of the spectrum that is inconsistent with the international allocation.
    Now here is how the ITU defines the different services allowed (Mobile, Radio-Location, Fixed Service, Broadcast-Satellite)...

    Mobile ~ Mobile-Satellite Service: A radiocommunication service: • between mobile earth stations and one or more space stations, or between space stations used by this service; or • between mobile earth stations by means of one or more space stations. This service may also include feeder links necessary for its operation.

    Radio-Location ~ Radiolocation Service: A radiodetermination service for the purpose of radiolocation

    Fixed ~ Fixed-Satellite Service: A radiocommunication service between earth stations at given positions when one or more satellites are used; the given position may be a specified fixed point or any fixed point within specified areas; in some cases this service includes satellite-to-satellite links, which may also be operated in the inter-satellite service, the fixed-satellite service may also include feeder links for other space radiocommunication services.

    Broadcast-Satellite ~ Broadcasting-Satellite Service: A radiocommunication service in which signals transmitted or retransmitted by space stations are intended for direct reception by the general public. In the broadcasting-satellite service, the term “direct reception” shall encompass both individual reception and community reception.

    Broadcasting Service: A radiocommunication service in which the transmissions are intended for direct reception by the general public. This service may include sound transmissions, television transmissions or other types of transmissions.

    Reuters: FCC could consider more conditions for XM-Sirius deal
    WASHINGTON, July 11 (Reuters) - The chairman of the Federal Communications Commission said on Friday he would consider proposing further conditions on Sirius Satellite Radio Inc's (SIRI.O: Quote, Profile, Research, Stock Buzz) acquisition of XM Satellite Radio (XMSR.O: Quote, Profile, Research, Stock Buzz) if it were needed to win support of other FCC commissioners.
